Speech Terms & Conditions

Effective Date: December 13, 2024

These Speech Therapy Terms of Service (“Speech Therapy Terms”) govern your access to, receipt of and use of the speech therapy services, including teletherapy services (“Speech Therapy Services”), provided by Expressable, Inc., its affiliated professional corporations (“Expressable PCs”), and all of their licensed speech-language pathologists and other providers (all of the foregoing, collectively, “Expressable”, “we”, “our” or “us”) through the Expressable platform. A full list of Provider Groups can be viewed here.

Speech Therapy Services are currently only available to individuals located in certain states. This list is subject to change without advance notice. Expressable, Inc. does not provide Speech Therapy Services in states where the corporate practice of speech-language pathology is prohibited.

Please read these Speech Therapy Terms carefully before using the Speech Therapy Services. By using the Speech Therapy Services, you agree to be bound by these Terms. If you are accepting these Speech Therapy Terms on behalf of another person (“Family Member”) as the parent of a minor Family Member or the Family Member’s guardian, conservator or custodian, you agree to these Speech Therapy Terms on behalf of such Family Member.

By requesting Speech Therapy Services, you certify that you are physically located in the state you select in the Expressable platform or otherwise confirm to us as your current location at the time of your receipt of Speech Therapy Services. Your ability to access Speech Therapy Services is conditioned on the truthfulness of this certification. You will be assigned to a Provider Group based on the location information you provide and any applicable insurance coverage. Expressable and the licensed speech-language pathologists and other providers that provide Speech Therapy Services rely upon this certification in order to interact with you. If your certification is inaccurate, you agree to indemnify us, the Provider Groups and the licensed speech-language pathologists and other providers with whom you interact from any resulting losses, damages, costs, or expenses.

By accepting these Speech Therapy Terms, you give your informed consent to participate in Speech Therapy Services, including telehealth speech therapy sessions.

Please refer to our HIPAA Notice of Privacy Practices to learn how Expressable collects, uses, shares and protects your Protected Health Information (as defined under the Health Insurance Portability and Accountability Act of 1996 or "HIPAA").

Your use of the Expressable platform through which Speech Therapy Services are provided is also subject to Expressable, Inc.’s Terms of Service.

Please review our Privacy Policy carefully so you understand what information we collect through the Services, how we use it, how we secure it, and when we may share it.

We may modify these Speech Therapy Terms from time to time. If we change these Speech Therapy Terms in the future, we will update the “Effective Date” to reflect the date of the changes. If we make material changes to these Terms, we will make reasonable attempts to notify you, such as by posting a notice on the Expressable platform, website or mobile application. If you do not agree with the proposed changes, you should discontinue your use of the Speech Therapy Services before the effective date of the change. If you continue using the Speech Therapy Services after the effective date, you agree to the modified Speech Therapy Terms.

Speech Therapy Services and Pricing

Evaluation (45-60 min): An evaluation is a formal assessment of all aspects of communication, including speech, language, voice, fluency, and social pragmatics to determine the presence of a delay or disorder. In certain cases, the speech-language pathologist may leverage standardized assessments norm-referenced for particular ages. Standardized evaluations are not required for a certified speech-language pathology to diagnose a speech or language disorder. However, many health plans require standardized scores to authorize services.

Recurring Treatment Sessions (30 min): A Recurring speech therapy treatment sessions, generally at a frequency of 1 or 2 sessions per week.

  • Prompt-Pay Price*: $88

*Prompt-pay discounts are available for clients who choose to keep a credit card on file with Expressable to be charged automatically.

You acknowledge that these rates may be modified or updated at any time. It is your own responsibility to remain informed about the current rates for the Speech Therapy Services.

Deposit Collection for Evaluation Reservation

Clients initiating services with Expressable may pay a non-refundable deposit to reserve their evaluation appointment. 

Clients that choose to self-pay for services without insurance will pay our standard pricing. 

Clients that choose to use their insurance will pay a deposit that may vary depending on whether Expressable is in-network or out-of-network with their insurance provider. The deposited amount will be applied to the client’s patient responsibility for subsequently completed speech therapy sessions. 

  • In-Network Deposit: $50

  • Out-of-Network Deposit: $175 prompt-pay discount*

*Prompt-pay discounts are available for clients who choose to keep a credit card on file with Expressable to be charged automatically.

Limits on Patient Responsibility With Insurance Billing 

Expressable has contractual obligations to honor the amount of patient responsibility dictated by a client’s health insurance plan when we are an “in network” participant. 

However, when a client chooses to pay for services using their out-of-network health insurance benefits, Expressable will apply a prompt-pay discount for clients who choose to keep a credit card on file with Expressable to be charged automatically. In these cases, we will charge no more than our direct pay rates outlined above. 

If a client’s claims are denied by their insurance provider, Expressable reserves the right to bill our standard prices for all completed and future speech therapy sessions. Clients will be responsible for any outstanding balance associated with completed speech therapy sessions. Expressable may discontinue billing claims to the insurance provider and charge our standard pricing. 

Please note that your insurance policy is a contract between you and your insurance company. If you have specific questions about the coverage in your health plan contract, please reach out to your insurance provider. 

Collection of Estimated Charges for Insurance Billing

If a client chooses to pay for services using their out-of-network health insurance benefits, or if their insurance plan requires a coinsurance, Expressable will charge an estimated fee at the time of each attended speech therapy session.

Insurance providers may deny claims based on service exclusions or medical necessity requirements. It is ultimately the client’s responsibility to determine if their speech therapy services will be covered by their specific health plan. If Expressable determines that a client’s insurance claims may have a higher likelihood of denial, we will charge an estimated fee based on the allowed amount required by the insurance provider until claims are adjudicated.

Patient responsibility is calculated by each insurance provider.

Once claims have been returned to Expressable, we will reconcile the difference between the amount collected at the time of service and the patient responsibility calculated by the client’s insurance provider within 30 days. Clients will either be refunded or charged the balance depending on the patient responsibility required by their insurance provider.

If a difference is refunded or charged, Expressable will revise the estimated amount collected for ongoing visits to better reflect the patient responsibility determined by their plan.

Consent to Telehealth Speech Therapy Services

We are providing this information on behalf of Expressable speech therapists:

Telehealth involves the use of communications to enable speech therapists at sites remote from patients to provide consultative and treatment services. The information may be used for diagnosis, therapy, follow-up and/or education, and may include live two-way audio and video and other materials (e.g., medical records, data from medical devices).

The communications systems used will incorporate reasonable security protocols to protect the confidentiality of patient information and will include reasonable measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption, including encryption of information transmitted through the Expressable platform.

You acknowledge that your speech therapists credentials were made available to you before scheduling an appointment. If you have any questions about these credentials, please direct them to your speech therapist.

Anticipated Benefits of Telehealth:

  • Improved access to medical care by enabling a patient to remain at his or her home or office while consulting a speech therapist.

  • More efficient speech therapy evaluation and management.

Possible Risks of Telehealth:

As with any health care service, there are potential risks associated with the use of telemedicine. Expressable believes that the likelihood of these risks materializing is very low. These risks may include, without limitation, the following:

  • Delays in evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment.

  • Security protocols could fail, causing a breach of privacy of your health information.

  • Information you transmit through the Expressable platform may be insufficient to allow for appropriate decision-making by your therapist.

By accepting these Terms, you acknowledge that you understand and agree with the following:

  • The Laws that protect privacy and the confidentiality of health information also apply to telehealth; I have received Expressable’s Notice of Privacy Practices, which explains how Expressable collects, uses, shares and protects your Protected Health Information in greater detail.

  • You may expect the anticipated benefits from the use of telehealth in your care, but no results can be or are guaranteed or assured by Expressable.

  • Your therapist will decide, in his or her sole discretion, whether it is appropriate to treat your condition using telehealth and the Expressable platform. Your therapist may request that you halt receiving telehealth services and instead receive in-person care if deemed appropriate.

  • Your healthcare information may be shared with others (including health care providers and health insurers) for treatment, payment, and healthcare operations purposes. In addition, your healthcare information may be shared in the following circumstances:

    • When a valid court order is issued for medical records.

    • Reporting suspected abuse, neglect, or domestic violence.

    • Preventing or reducing a serious threat to anyone’s health or safety.

    • As otherwise permitted by applicable Law.

  • You will hold Expressable harmless for any information lost due to technical failures of the Expressable platform when receiving telehealth services.

Financial Responsibility and Assignment of Benefits

You agree to pay Expressable all applicable charges at the prices then in effect for the Speech Therapy Services provided to you or your Family Member. You authorize Expressable to charge your saved payment method (your "Payment Method") for the Speech Therapy Services provided to you or your Family Member. If your Payment Method is invalid at the time payment is due, you agree to pay all amounts due upon demand. The third party services provider who manages your Payment Method may impose terms and conditions on you, which are independent of these Speech Therapy Terms, and you agree to comply with all of those terms. Expressable may accumulate charges that you’ve incurred for the Speech Therapy Services and submit them as one or more aggregate charges during or at the end of each billing cycle. Expressable reserves the right to correct any billing errors or mistakes even if payment has already been requested or received.

If you provide information about your health insurance or health plan, that will be deemed your authorization for us to submit claims for covered Speech Therapy Services to your health insurer or health plan. You hereby assign or otherwise authorize payment of medical benefits to Expressable for the Speech Therapy Services provided to you or your Family Member. You authorize the release of any health or other information necessary to process any claims for the Speech Therapy Services. You further understand and accept your financial responsibility for any portion of the bill not covered by your health insurer or health plan. SUBMISSION OF CHARGES DOES NOT WAIVE OUR RIGHT TO SEEK PAYMENT DIRECTLY FROM YOU.

Service Termination for Outstanding Balances

Expressable requires that payment for all prior appointments be complete before proceeding with an additional appointment. 

We reserve the right to terminate services if there are two or more consecutive unpaid speech therapy visits, or there is an unresolved outstanding balance for past services.  

Attendance and Cancellation Policy

Recurring Appointments 

A minimum visit frequency of once a week is required to reserve a recurring appointment slot on your speech therapist’s calendar. 

If you choose to receive services at a lower visit frequency, or if your speech therapist recommends a lower frequency, you may schedule one upcoming visit at a time. These appointments will not be reserved on a recurring basis, and can be scheduled individually by texting your speech therapist at 512-960-3535. 

Individual appointments are also subject to the Cancellation and Missed Appointment policies listed below. 

Cancellations

If you were unable to attend a session due to an extenuating circumstance, please text or call us at 512-960-3535. Texting is the fastest way to reach your speech therapist directly. 

Canceled or Missed Evaluation: Evaluations canceled with less than 24 hours notice, or missed with no prior notice, are eligible for a one-time courtesy rebooking pending availability and at the discretion of your speech therapist. Deposits for evaluations are non-refundable.

Canceled or Missed Sessions:

  • Rescheduling Sessions: If you are unable to attend a scheduled appointment, you can request to reschedule if you provide more than 24 hours notice. We do not consider rescheduling an appointment a cancellation. However, your ability to reschedule a recurring appointment will be dependent on the availability and discretion of your speech therapist.

  • Late Cancellation of Sessions: Late cancellations occur when an appointment is canceled with less than 24 hours notice.

  • Missed Sessions: Missed sessions occur if a client does not attend their scheduled speech therapy visit with no advance notice, or if the client is 10 or more minutes late to their appointment. Missed appointments are subject to a $25 fee that may be charged to your Payment Method. 

Frequent late cancellations or missed appointments that do not adhere to our attendance policy below may result in the termination of treatment. 

Therapist Cancellations. If a session is canceled because your therapist is unable to attend on the scheduled time, we will attempt to reschedule that session at a time of your convenience. You will not be charged if your therapist cancels your appointment for any reason and the appointment cannot be rescheduled.

Late cancellation and missed appointment fees will not be charged when prohibited by law.

Attendance Policy

Speech therapy outcomes require consistent attendance and we expect clients to attend or reschedule any recurring appointments. Frequent cancellations or inconsistent attendance may result in the termination of treatment.

We reserve the right to terminate treatment if:

  • 2 or more consecutive appointments are late canceled or missed

  • 2 or more appointments are late canceled or missed in a 4-week period

  • 3 or more appointments are late canceled or missed in a 12-week period, or if appointment attendance is less than 80% based on care plan frequency in any 12-week period

  • Attendance patterns are determined to be impacting clinical outcomes

Caregiver Attendance 

If you are a parent or caregiver of a minor child Family Member, you are encouraged to attend all appointments when possible. If your minor child Family Member is under the age of 7, you or another authorized adult caregiver must be present for all appointments. If your minor child Family member is 7 years of age or older, you may be required to be present for all appointments if deemed necessary based on the clinical judgment of your speech therapist.

Telehealth Session Environment

To ensure the best possible experience and outcomes during your speech therapy sessions, we ask that all appointments be conducted in an environment that is conducive to focused and productive therapy. A quiet, private space free from distractions is recommended for both the client and caregiver.

Parking Lot/Vehicle Sessions: Evaluations and sessions conducted in a parked vehicle may face connectivity issues that can disrupt the session. For clients under the age of 7, it is particularly important that the session take place in a stable environment to ensure effective participation.

Sessions in Moving Vehicles: Sessions conducted in a moving vehicle, even if the caregiver is driving and the minor is attending the session independently, are not conducive to clinical success due to poor audio quality, lack of caregiver involvement, and potential connectivity concerns. Expressable policy is to request the client or caregiver park the vehicle to complete the visit to support therapeutic progress. If the client or caregiver is unable to do so, the visit will be considered a no-show.

  • Exception: The Speech-Language Pathologist (SLP) retains the discretion to make an exception to this policy in cases where clinical judgment indicates that the session can still be reasonably achieved under the circumstances of a minor client attending while the caregiver drives a moving vehicle. This may apply if attending therapy in this setting is essential to the family’s ability to consistently participate in sessions. In such cases, the SLP will assess whether the session can still meet the clinical needs of the client.

Community/Public Spaces: While sessions conducted in community environments (e.g., public parks, cafes) are permitted, these are done so at the discretion of the client or caregiver. Please be aware that external noise or interruptions may impact the quality of the session.

We strongly encourage you to ensure that the location for your telehealth session supports a productive, distraction-free experience for the best possible therapy outcome.

Service Termination

You may terminate your use of the Speech Therapy Services at any time by not using the Speech Therapy Services any more. We may terminate your use of the Speech Therapy Services at any time in our reasonable discretion, for causes including but not limited illegal conduct, abusive and threatening behavior, and continued refusal to pay for our services. We may terminate your use of the Speech Therapy Services by sending notice to you at the mail or email address you provided to us or by otherwise contacting you.

Consent to Electronic Communications

You agree that Expressable may send the following to you by email or by posting them on our website and mobile application: legal disclosures; these Speech Therapy Terms, Notice of Privacy Practices; future changes to any of the above; and other notices, policies, communications or disclosures and information related to the Speech Therapy Services. You agree that Expressable may contact you via secure messaging, email, phone, text, or mail regarding the Speech Therapy Services. You consent to receive such communications electronically. You agree to update your contact information to ensure accuracy

If you later decide that you do not want to receive certain future communications electronically, please send an email to help@expressable.io or a letter to Expressable, 7600 Chevy Chase Drive, Suite 300 - #325, Austin TX, 78752. You may also opt out of certain electronic communications through your account or by following the unsubscribe instructions in any communication you receive from Expressable. For example, you may opt out of receiving automated text messages by texting STOP in response to any automated text message. Your withdrawal of consent will be effective within a reasonable time after we receive your withdrawal notice described above. If you opt out of automated text messages, you acknowledge that you will still receive non-automated text messages from your speech therapist related to the Speech Therapy Services that you receive.

TO THE MAXIMUM EXTENT NOT PROHIBITED BY LAW, EXCEPT IN CASE OF NEGLIGENCE OR WILLFUL MISCONDUCT, WE AND OUR AFFILIATES, PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE, INCLUDING PERSONAL INJURY OR DEATH, RESULTING FROM ANYONE'S USE OF OR INABILITY TO USE THE SPEECH THERAPY SERVICES.

The Speech Therapy Services are intended for use only within the United States and its territories. We make no representation that the Speech Therapy Services are appropriate, or are available for use outside the U.S. Those who choose to access and use our Speech Therapy Services from outside the U.S. do so on their own initiative, at their own risk, and are responsible for compliance with applicable laws.

Limitation of Liability

TO THE MAXIMUM EXTENT NOT PROHIBITED BY LAW, IN NO EVENT WILL EXPRESSABLE AND OUR AFFILIATES, PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION THOSE RELATING TO LOST PROFITS OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES ARISING OUT OF OR IN CONNECTION WITH THE SPEECH THERAPY SERVICES OR FROM THE USE OF OR INABILITY TO USE THE SPEECH THERAPY SERVICES, WHETHER BASED ON CONTRACT, WARRANTY, PRODUCT LIABILITY, TORT OR OTHER LEGAL THEORY AND EVEN IF WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

General

We may change, suspend, or discontinue any of the Speech Therapy Services at any time. We will try to give you prior notice of any material changes to the Speech Therapy Services. We will not be liable to you or to any third party for any modification, suspension or discontinuance of the Speech Therapy Services. These Speech Therapy Terms do not confer any third-party beneficiary rights. You may not transfer any of your rights or obligations under these Speech Therapy Terms to anyone else without our consent. Expressable may assign our rights in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. Even after termination, these Speech Therapy Terms will remain in effect such that all terms that by their nature may survive termination will survive such termination.
